Larger Values isn’t where all inventions must go
Not all the new innovations yield examples with numbers that are simply larger than the previous art.
In a past mother of all cases where an additive was able to increase adhesion values of pressure sensitive adhesives, the additive also worked to make release liners work better- but that results in lower release values, to be “better” that is.
After reaching final rejection we were able to show why better adhesion values mattered and was novel- so only the claims to a “larger value” were allowed. The group including attorneys were ready to fly in person for the final arguments, but I suggested one more letter should be sent….explaining Every example and why the values show meant it was better than the art and the controls. For the adhesives- yes the data showed higher values of adhesion. Bit the the release liners surface coating the values were all lower. Meaning the adhesives did not stick….wel better. The final argument was simply if you use your same logic to grant the adhesion claims you must use the same logic to grant the release claims.
The call came that it was all granted 2 hours before boarding the plane!
It wasn’t our logic that convinced the examiner- it was his, once we’d taught that for release smaller is better!
